Terms of Use

The rules for using UP – Universe Path: what the app is, what it is not, where its information comes from and how the subscription works.

1. Acceptance

By downloading or using the UP – Universe Path app, you agree to these terms and to the Privacy Policy. The app is distributed through the App Store and is also subject to Apple’s standard Licensed Application End User License Agreement. These terms supplement that agreement; if they conflict on licensing of the app, Apple’s agreement prevails.

2. What UP is

UP is a companion guide for following movie and series universes: it shows a suggested order to arrive ready for a release, what you still have to watch and your progress.

UP does not host, stream, sell or distribute movies, series, episodes, trailers or any video. To watch, you use each title’s official services, under their own rules.

Journey orders, groupings and recommendations are UP’s own editorial curation, a suggestion from UP, and do not represent the official position of any studio.

3. Independent, unofficial app

UP is an independent, unofficial app created by an independent developer. It is not affiliated with, endorsed, sponsored or approved by Marvel Entertainment, Marvel Studios, 20th Century Studios, The Walt Disney Company, Toho Co., Ltd., Legendary Entertainment, Warner Bros. Entertainment, Sony Pictures Entertainment (TriStar) or any of their affiliates, nor by any other studio, distributor, streaming service or rights holder of the franchises mentioned in the app.

The presence of a title, character or service in UP does not indicate a partnership, a commercial endorsement or any relationship with its rights holder.

4. Third-party trademarks and rights

All titles, characters, names, trademarks, logos, posters and images of movies and series belong to their respective owners. They appear in UP only to identify the works and as reference. UP claims no rights over them, and nothing in these terms grants you any license to that material.

5. Removal requests

If you are a rights holder, or represent one, and believe that content in UP or on this website infringes your rights, write to agivigir [at] gmail.com with the subject “Rights – UP”, including:

  • who the rights holder is and, if applicable, how you represent them;
  • which work or trademark is affected;
  • where the content is in the app or on the website (screen, title or address);
  • a contact for our reply.

Requests are handled with priority, and the content may be removed or replaced while the matter is resolved.

6. Data sources

Catalog information and images for movies and series are provided by TMDB (The Movie Database). This product uses the TMDB API but is not endorsed or certified by TMDB.

Streaming availability data (“where to watch”) is provided by JustWatch through TMDB.

Upcoming release dates, journey orders and editorial texts are prepared by UP from these sources and from public studio announcements.

7. Accuracy of information

UP’s information is provided “as is”. It may be incomplete, outdated or inaccurate, especially:

  • release dates, which studios change often;
  • availability on streaming services, which varies by country and over time;
  • synopses, runtimes, ratings and cast from third-party sources.

Before making a decision based on this information, such as subscribing to a service or buying a ticket, check the official channels. The streaming services mentioned belong to their owners; UP has no relationship with them and is not responsible for their catalogs, prices or conditions.

8. Third-party links and services

UP may take you to third-party websites and apps, such as TMDB or streaming services. These services have their own terms and policies, and UP neither controls nor is responsible for their content, availability or practices.

9. Ads

The free version shows ads served by Google AdMob. Ads are the responsibility of their advertisers and are not a recommendation from UP. Ads are always identified as such and kept apart from the editorial curation. Details about data and choices are in the Privacy Policy.

10. UP Pro subscription

UP Pro is an optional, auto-renewable subscription that removes the ad banners and unlocks every app icon. The core of UP stays free.

  • Plans: monthly and yearly. Prices, taxes and currency are those shown on the App Store at the time of purchase and may vary by country.
  • Free trial: when offered, it lasts 7 days. When the trial ends, the subscription is charged unless you cancel before. If you subscribe during the trial, any unused portion of the free period is forfeited.
  • Payment and renewal: payment is charged to your Apple Account at confirmation of purchase. The subscription renews automatically for the same period unless canceled at least 24 hours before the end of the current period. Renewal is charged within the 24 hours before the period ends.
  • Cancellation: in iPhone Settings → [your name] → Subscriptions. Cancellation takes effect from the next period, and the benefits stay active until the end of the period already paid.
  • Refunds: handled by Apple, under its rules, at reportaproblem.apple.com.
  • Family Sharing: included, under Apple’s rules.
  • Restore purchases: available on the subscription screen, to use UP Pro on another device with the same Apple ID.

If the subscription ends, the app goes back to the free version, with ads and the default icon. Your progress is not affected.

11. Acceptable use

UP is for personal, non-commercial use. You agree not to:

  • copy, bulk-extract or redistribute UP’s catalog, journeys or editorial texts;
  • try to circumvent the ads, the subscription or the app’s security mechanisms;
  • reverse engineer the app, except where the law expressly allows it;
  • use the app or UP’s servers in a way that harms the service or other people.

12. Ownership of UP

The UP – Universe Path name and brand, its design, its own icons, its code and its editorial curation (journey orders, groupings and texts) belong to the developer. These do not include the third-party material described in section 4.

13. Limitation of liability

To the fullest extent permitted by applicable law, UP and its developer are not liable for:

  • decisions made based on incomplete, outdated or inaccurate information in the app;
  • the content, availability, prices or practices of third-party services, including streaming services, TMDB, advertisers and Apple;
  • interruptions, failures or data loss caused by factors beyond the developer’s reasonable control, such as device, iCloud or connection failures.

Nothing in these terms excludes rights that the law grants you and that cannot be limited by contract, including those under Brazil’s Consumer Protection Code and the consumer laws of your country.

14. Availability and changes

UP may gain, change or lose features, universes and content over time, including at the request of rights holders or data providers. These terms may also change: the current version is always on this page, dated at the top, and significant changes will be announced in the app or on this website.

15. Governing law

These terms are governed by the laws of the Federative Republic of Brazil. If you are a consumer, you may bring a claim in the courts of your place of residence, and you keep the protections of the mandatory laws of your country.
